A deferred judgment may be available in a Colorado domestic violence case, especially for a first-time misdemeanor defendant, but it requires the prosecutor’s agreement, the defendant’s guilty plea, court approval, and successful completion of written conditions. It is a path toward dismissal, not an immediate dismissal.
If the defendant completes the agreement, the guilty plea is withdrawn and the charge is dismissed with prejudice. If the court revokes the deferred judgment after a violation, it can enter judgment and impose sentence on the existing plea.

A Deferred Judgment Begins With a Guilty Plea
Under Colorado Revised Statutes section 18-1.3-102, the court can defer judgment and sentencing when the defendant, defense counsel, and prosecutor consent in writing.
The plea remains in place during the deferral period. That matters because a violation proceeding does not start from the same position as an untried case. The court may enter judgment on the plea if the agreement is revoked.
Before accepting, read every condition, the violation standard, the duration, and the promised disposition.
First-Offense Cases Often Have the Strongest Path
A deferred judgment may be a realistic favorable result for some first-time misdemeanor domestic violence defendants. It is not guaranteed. The alleged conduct, injuries, criminal history, victim position, jurisdiction, and available defenses can change the offer.
Repeat defendants face a harder negotiation. Individualized mitigation can help explain why a deferred resolution would still serve accountability and public safety.
A generic demand for the “first-offender deal” is weaker than a documented proposal addressing the case’s actual concerns.
Conditions Resemble Probation
Colorado Supreme Court authority explains that deferred-judgment conditions resemble probation conditions. In a domestic violence case, the agreement may require:
- domestic violence evaluation and treatment;
- alcohol or substance-use assessment and treatment when relevant;
- no new offenses;
- compliance with protection orders;
- supervision and reporting;
- payment of restitution, fees, or costs; and
- any additional written case-specific condition.
Many misdemeanor deferrals last one or two years, but the signed stipulation controls the actual period.
Successful Completion Produces Dismissal
When every required condition is completed, Colorado law provides for withdrawal of the guilty plea and dismissal of the charge with prejudice.
Dismissal and sealing are related but distinct. Colorado treats eligible dismissed deferred-judgment cases as non-convictions for sealing purposes, subject to statutory exceptions and court procedures. Do not assume the public record vanished on the final supervision date. Confirm that sealing occurred or complete the required process.
Certain offenses and records have special rules. Immigration, firearms, professional licensing, and federal background questions may also use definitions different from ordinary public-record access.
A Violation Can Convert the Plea Into Judgment
Missing treatment, violating the protection order, committing a new offense, or failing another material condition can trigger revocation proceedings.
The defendant receives procedural protections, but the risk is real: the court can enter judgment and sentence on the plea already given. A new protection-order case can also weaken the negotiated position in the original case.
Do not contact the protected person merely because that person initiated contact. Private reconciliation cannot modify the order.
County Patterns Inform Strategy but Do Not Guarantee Offers
Resolution practices can vary by jurisdiction. Denver and Arapahoe cases may produce deferred-judgment discussions, while some neighboring jurisdictions may use diversion or class-for-dismissal resolutions more often. Jefferson County may be less flexible in comparable cases.

Review the Agreement Before You Plead
